FOR THE PLAINTIFFS
At 11:30 all are assembled.
"Bailiff, please let in the jury."
The jury enters the room and is seated.
"Have you reached a verdict?" Judge Whittaker asks the forewoman.
"Yes, we have your honor," she says.
"Please read it."
"We, the jury, find for the plaintiff and establish negligence on the part of Ocean Realm International and their divemaster Charlene Marvich in the death of Jennifer Arlene Knowlton. However, we also find that the deceased contributed to her own death because of evident over weighting and apparent intent to harm herself. On the issue of negligence we award monetary damages to the plaintiffs of $10,000. Per instructions of the court we award no punitive damages."
"You have discharged your duty," says Judge Whittaker. "We thank you for your patience and attention. This jury is dismissed. The decision is entered into the court record. There is a thirty day period during which either side may appeal this decision."
Pearson stands. "Your honor, we respect the jury's decision and wish to serve notice today that we will appeal the decision on monetary damages. We believe the decision is a correct one but that the monetary award does not do justice to the magnitude of the negligence."
Before Pearson takes his seat Kirkland is standing. "Your honor, we believe that there are several issues placed before this court that deserve a higher hearing. We announce out intention to appeal this decision."
"Fine, gentlemen. This court is adjourned."
